PLEASE READ CAREFULLY – THIS IS A LEGAL DOCUMENT
By signing this agreement, you acknowledge and accept the risks associated with the use of kayaks, paddleboards, and related equipment, and waive certain legal rights, including the right to sue.
1. Acknowledgment of Risk
I, the undersigned, hereby acknowledge that participating in activities such as kayaking and paddleboarding involves inherent risks, including but not limited to:
Drowning, capsizing, and collision with objects or other watercraft
Exposure to sun, heat, marine wildlife, and sudden changes in weather
Injuries such as cuts, sprains, strains, or more serious harm
Equipment failure or misuse
I freely accept and assume all risks, known and unknown, associated with these activities.
2. Health, Safety, and Age Requirement
I confirm that I am in good physical health and able to safely participate in kayaking and/or paddleboarding. I agree to wear a personal flotation device (life jacket) at all times while on the water.
I understand and agree to the following safety and age policy:
Participants must be at least 12 years old to use or ride in a kayak.Children under the age of 12 are strictly prohibited from using or being seated in any kayak, including tandem kayaks.
I agree not to participate if I am under the influence of alcohol, drugs, or medications that impair judgment.
3. Release of Liability
In consideration of the rental and use of equipment provided by Tranquil Tides Water Sports, I hereby release, waive, and discharge the business, its owners, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action for personal injury, property damage, or wrongful death that may result from participation in these activities.
This release is binding on myself, my heirs, assigns, and personal representatives.
4. Equipment Responsibility
I acknowledge that I am fully responsible for any damage to or loss of the equipment during my rental period. I agree to return the equipment in the same condition it was provided, normal wear and tear excepted.
5. Governing Law
This agreement shall be governed by the laws of The Commonwealth of The Bahamas. Any legal disputes will be resolved in the jurisdiction where the business is located.
